Our auction terms of sale may vary with each auction as we make adjustments. Please review the Terms of Sale for each auction before placing a bid as they may have changed

We have attempted to accurately describe all items being sold, but all property offered for sale is strictly ‘as-is’. We have provided substantial images of all items offered to best inform potential absentee or online bidders with regards to item condition. It is the bidder’s responsibility (whether in-person, by phone, by mail, or via the Internet) to determine the exact condition of each item. We will endeavor to help Bidders with any request made prior to the auction. No statement in this catalog, sale bill, invoice, or other document by associates of The Artifact Company, LiveAuctioneers.com, or the Principle Auctioneer shall be deemed to warranty, or as representation or assumption of liability with respect to age, condition, size, quality, value, marketability, importance, rarity, variety, typology, provenance, or historical reference as related to any sale items. Any such statements are strictly matters of opinion. NO implied warranty for suitability of purpose or any other form of implied warranty is made by The Artifact Company or Auctioneer.

If an item marketed as prehistoric already has a certificate of authenticity from one or more of the following artifact authenticators: Jackson, Stermer, Bennett, Motley, T. Davis, Rogers, Dickey, Berner, Partain, Cox, Howard, Tatum, Williams, Meadows, E. Rowe, Putty, or Perino; the sale shall be considered final. Repeat – If an item already has a certificate of authenticity from one or more authenticators listed above the sale shall be considered final, NO EXCEPTIONS. Everything else (with the exception of items offered as ‘decorative’ ‘REPRO’ ‘REPRODUCTION’, ‘Exact Age Unknown’ or ‘contemporary’) is guaranteed for 30 days from auction date to paper as ‘authentic’ by any authenticator living and mentioned above. Differences of opinion amongst authenticators regards ‘type’ or ‘material’ will not qualify as reasons for a return. Self-Authentication is not recognized and is considered ‘Buyer’s Remorse’ and returns of this type WILL BE DENIED. Any item eligible for return with request for refund must be accompanied with a full written report of the examination from the examiner. Authentication is a matter of scholarship and we welcome you to utilize the experience of your preferred expert for consultation prior to sale. You may arrange to have your expert inspect a potential purchase prior to a sale by calling 1-800-466-3836.

Reserve and Buy-Back rules are in effect for this sale. This means that This auction likely contains items with reserves (usually not more than 10% of the total lot count) and that consignors may buy back their own items. Liberty to bid is reserved by the Auctioneer.

ALL VALID RETURNS MUST BE APPROVED PRIOR TO RETURN BEFORE THE 30TH DAY AFTER THE AUCTION! IF YOU NEED OR WANT ADDITIONAL TIME, YOU MUST ARRANGE FOR THIS IN ADVANCE OF THE AUCTION DATE! NO EXCEPTIONS! This means that if you fail to exercise your right to seek independent authentication during the allowed time, there will be NO adjustments or returns allowed past the 30th day after the auction. Any contingencies must be arranged BEFORE bidding begins on the auction. Contingencies MAY NOT be arranged for the day of the auction, please contact us in advance to arrange for any special requests or exceptions to the Terms stated herein. The Auctioneer (or in the case of Internet-only auctions – LiveAuctioneers Bidding Software) will be the final judge as to which bidder is the highest bidder. In event of any dispute in this matter the Auctioneer or Terminal Operator shall use his own discretion to decide whether to reopen bidding or not. Title to all merchandise shall pass to the highest bidder at the fall of the Auctioneer’s “Hammer.” The Paper records of the clerk are the true record of sale under Kentucky State Law, regardless of conflicting information reported by the LiveAuctioneers.com bidding service. After a sale, all winners via the LiveAuctioneers.com system must be ‘certified’ against these paper records, and in case of conflict, the paper record will be the true and accepted record.

The Purchaser shall assume full risk and responsibility for the lot purchased once title has passed. This includes liability for any issues arising through shipment. Auctioneer accepts no liability for in-house shipments agreed to by the purchaser. Purchaser MAY request insurance on in-house shipment however Auctioneer no-longer automatically insures packages.

The buyer must pay Kentucky State Sales Tax (6%) unless exception is allowed under laws regulating such tax. Out of state sales tax numbers will be accepted. You do not pay Kentucky Sales Tax if items are shipped out of state. All accounts must be settled by sale’s end for Floor Bidders, or within 14 days of receipt of Invoice for Absentee/Internet/Phone Bidders, unless other arrangements have been made. Payment may be made by cash, personal check (with id), Money Order, or major credit card/PayPal. No items removed until paid in full. The Artifact Company reserves the right to hold items until payment clears. Incomplete Payments may be voided and funds returned at Auctioneer Discretion should other arrangements not be made by buyer and sale cancelled. The buyer will be marked as a NON-PAYING BIDDER for future sales and barred from participation. See end of these terms for more details.

Late Payment/Storage Fees: All Bidders agree to 5% per 30 day period compounding interest on any unpaid balance starting with the auction date. This interest is added to any open invoice on the 30th day after the auction if other arrangements have not been made. If purchases go uncompleted for more than 120 days after an auction, Bidder authorizes The Artifact Company to re-auction the items to satisfy the remaining balance, also authorizing The Artifact Company a seller commission of 25% on the sold items. Should any amount remain after auctioning the unpaid items, the delinquent bidder shall receive any monies in excess of the amount originally due including all fees and commissions. The Artifact Company or its Auctioneers are not responsible for any typographical error or omission in this catalog. Photographs in this catalog are of the actual items being sold, but exact condition of the objects offered is their condition the day of the sale. There will be absolutely NO returns or adjustments of any kind made 30 days after Auction date. We reserve the right to refuse admittance to any individual or group. Customers interested in acquiring additional documentation or certificates should make arrangements prior to the sale. Additional documentation is only available at current market rate and should not be considered ‘complimentary’.

Buyer’s Premium: All online bidders will pay a 20% buyer’s premium on any successfully executed purchase. Phone and Absentee bidders will pay 18% premium. There will be a 3% reduction in premium for payment via cash or approved check. Shipping: We will ship and insure items purchased through Absentee and Internet bidding to your wishes. A nominal Shipping and Handling fee will be assessed per package with regards to postage and any insurance requested. We accept NO LIABILITY for damaged, lost, or stolen shipments. Winning bidders may elect to pick-up merchandise at our Mount Sterling Gallery location instead. Internet Bidding: We are pleased to offer Internet bidding via the LiveAuctioneers.com web site. You must register with LiveAuctioneers well in advance for this sale even if you have previously registered an account. Feel free to contact us if you are having difficulties registering online.

NON-PAYING BIDDERS: Non-Paying or uncontactable bidders will be barred from future sales. NO EXCEPTIONS! The non-paying bidders information will then be shared with other auction houses in order to prevent the bidder from causing issues for other sellers.
